I cannot speak for others who do not take bait & switch seriously. But it sure is clear that I do, isn't it? Especially when it involves a $45,000 motor vehicle. In any event, the case would be tossed out of court immediately.
No, a sale does not need to take place for "bait and switch" to occur or be illegal. The offense is the deceptive advertising and intent to lure customers without planning to sell the bait item, often shown by refusing orders, disparaging the bait, or using sales incentives against it.
