I've noticed that too; the highway assist is not consistent. I drive on the same highway every day, and sometimes it works, while other times I receive the unavailable message.

I had the same issue with my X7. I think it's just the nature of the 360 camera, unless they install separate cameras on the roof of the vehicle for a true 360 view without distortion.
