For those that had a BPA and just filed (or Amended) their return for the $7,500 credit. What did you put as your delivery date? I think the instructions Rivian sent out with the guidance said to use Aug 15 2022 as the Purchase Date...but is that the same for the date the vehicle was put into service (since it asks for both dates)?

Use the date that is listed on your BPA as your "purchase" date (mine was 8/10/22) and 8/15/22 for "put into service" since you're applying the transition rule.

" From the Guidance: “To elect the credit under the prior rules you must elect the credit on your 2022 tax return after you take delivery of the vehicle. Depending on the date the vehicle is delivered, you can claim the credit on your original, superseding, or amended 2022 tax return.” "

I do wonder what would happen if the IRS asked Rivian for a list of all the VIN #s for R1's that were flipped with 50 miles or 'less than 30 days of ownership' to a 2nd owner... invalidating the legitimacy for the first owner (the flipper) to claim the $7500. Heck, the IRS could catch a bunch of people just watching CarsandBids. Doubt it would ever happen, but the IRS would sure have fun with it.

Thankfully I'm keeping my R1S and re-filing my '22 taxes to happily take the credit.

Our amended 2022 return claiming the tax credit was disallowed by the IRS. Any one else getting denied? I am assuming it is because the model year is 2023? Signed the contract on 8/15/22, took delivery May 7, 2023.

Our amended 2022 return claiming the tax credit was disallowed by the IRS. Any one else getting denied? I am assuming it is because the model year is 2023? Signed the contract on 8/15/22, took delivery May 7, 2023.

Seems to have been disallowed immediately.
From the IRS certified letter:
"We can't allow your credit because the vehicle you listed does not follow under the Manufacturers and Models for New Qualified Clean Vehicles Purchased in 2022 and Before list."

I also see under the Rivian tab of that page it only shows model year 2022 is allowed. Is this new? It actually contradicts other info on the IRS website stating early 2023 models are included.

Weird. That makes me a little worried about what's going to happen to my amended return that I filed yesterday! I hope someone else will come along and share a different result with a filing like ours for 2023 model year and using the transition rule (purchase agreement prior to 8/16/22).

You might want to forward that letter to your Rivian guide to let them know of this potential issue. I see that at least Audi and BMW have 2023 model year vehicles on the 2022 eligibility list. That's likely because paperwork for that was submitted in 2022 when they both started selling 2023 MY vehicles, but Rivian might also need to submit something confirming that they haven't yet sold 200k vehicles.

I did the same thing as you and noticed the manufacturers with 2023 MY vehicles listed. It does seem a bit like a clerical error, but I am not sure if it is a Rivian or IRS mistake. Either way it's now a headache for us that get denied. Our R1S is going in for service on Thursday so I will definitely bring this up with our guide. I do plan to appeal.

I would email the guide assigned to your account online, not just the person at the service center.

For those of you that have received the tax credit and have been refunded by the IRS what model year are you putting on Form 8936? Just wondering if anyone who has a 2023 MY has gotten the credit. I assume that is most of you, but just trying to get to the bottom of my denial.

I submitted an amended form for 2022 with model year 2023 and initial text said IRS has accepted my amended return. That’s was a week ago.

I still don’t see a status under my amended return status tool when I check.

for now I expect them to send me $7,500 and then audit me because of 2023 model year which would then require me to file it under 2023 tax return and get half the credit.

I hope Rivian submits everything to IRS so we don’t have issues or get amended but I’m not holding my breath.

I submitted my amended 2022 return June 1st, the day I received my 2023 R1S, and it was accepted in a couple days by the IRS. Since then I have been tracking it via the IRS website and it just recently made it through the Adjusted phase, which should result in the full credit being sent in the next couple weeks. Fingers crossed.
