I got a message from DOR that the credit was rejected in my 2023 filing. I don't have binding agreement (my fail) and took delivery October '23.
Has anyone had their's accepted? I was going to the DOR portal to upload the purchase documents when I found the message - so it's unclear if it was flat rejected or was lacking the documentation. I'm assuming it was for the missing title/purchase docs, because it matches the Light-Duty GVWR criteria.

The credit has been disallowed. The Gross Vehicle Weight Rating (GVWR) was not in the allowable range for the vehicle type selected. If you disagree, please provide all necessary documentation (purchase or lease agreement, Colorado motor vehicle registration, and window sticker) for the qualifying vehicle along with a copy of this letter

Did you file under light duty truck or passenger? I did passenger and it says "approved" pending review.

Well I spoke too soon. I got the same letter on the mail just now and I think its because the registration doesnt show GVWR. I took a photo of the sticker on the door well with the VIN and plan to use that to appeal. We will see how that goes. Otherwise I see no other document that shows GVWR.

I received my rejection to a $2,000 credit claim today for my R1S on my 2023 tax return.

"The credit has been disallowed. The Gross Vehicle Weight Rating (GVWR) was not in the allowable range for the vehicle type selected......" They also say "For additional information see Income Tax Topics: Innovative Motor Vehicle Credit.""

I listed a GVWR of 8,532. The Tax Topic: Innovative Motor Vehicle Credit (as some of you already know) only addresses vehicles with a GVWR of 8,500 pounds or less (except as noted below). In their denial of the credit, they make no reference to the Tax Topic: Innovative Truck Credit which clearly provides a $2,000 credit for Light-Duty Passenger Motor Vehicles with GVWR of 8,501 to 10,000. And, as the first Tax Topic notes, "A light-duty passenger motor vehicle with a GVWR of more than 8,500 pounds may quality for the innovative truck credit, rather than the innovative motor vehicle credit.

I will appeal their denial of the credit, but expect this will be a drawn out process. If anyone is successful in claiming the $2,000 credit on their 2023 return for a R1S, please let me know. Thanks.

See my situation above. I was able to submit the vehicle registration and purchase agreement. I think they are rejecting all claims for light-duty passenger motor vehicles with a GVWR of greater than 8,500. I can't tell if they are drawing a distinction between a R1T (a truck) and a R1S (a passenger MV)

I spoke with Rivian customer service today and they referred me to the owner's manual. It does have the GVWR.

Rivian did not have a separate document from the manual with the GVWR.

I got the same letter for my R1S. I'm wondering if I should just put the 7033lb empty weight on my registration and file for the $5,000 credit. No surprise they seem to have no clue what they are doing at the DOR.

CODOR has been such a pain the last couple of years. So are they saying it's supposed to be below 8,000 and should claim the $5k instead (for the late 2023 deliveries)? I haven't filed yet, but this is silly. I swear all these EV credits have been made so unnecessarily complicated, that the agencies don't even know how to apply the code.

Given the 80k MSRP limit on that law, this isn't an option for post-hike people. Any tax lawyer recommendations? ?
Yeah, I was pre-price hike. You shouldn't need a tax lawyer. Just stay on them - they'll get there. It may take some time, but CDOR usually responds in a reasonable amount of time (unlike the IRS or California FTB). If they still deny after proof of GVWR (I'd send the door decal and owners manual), then give them a call and see what is going on. May not hurt to call before responding and see if they can advise you of what specifically will satisfy that GVWR proof requirement.

I filed my protest yesterday online with a detailed analysis of the statutes which concludes that $2,000 is the correct credit for my R1S with a GVWR of 8,532. I believe that the analysis is correct, but if nothing else, I hope it forces them to provide their reading of the statutes. The adjustment notice seemed purposely vague.

My R1T purchased in Colorado in 2023 was also just rejected... I applied for the $2800 Light Duty Truck credit. Is the state DOR trying to pull a fast one on us?

Really curious if anyone for 2023 has been successful yet and how they went about it. I still need to file, but got mine in March, so before the rule change.
