Rivian Assistant not available with no one in driver seat

I'm trying to figure out if this is the way the RA is supposed to work or if something is wrong with mine.

I am trying to use the RA while loading things in the car and it will respond that it is unavailalble. My main use is when I am loading a child in the back seat and I ask RA to open the frunk, turn on music, etc. I was able to do this with the Alexa assistant.

My googling and searching are not showing anything. Is this the intended operation, or is something buggy?

Yea I noticed this too. It's annoying when I'm loading the kids in the car or things in the back. But as soon as I open the driver door it works

Used to be able to tell Alexa to turn on the HVAC or vent windows while loading up the kids, can't seem to do that anymore with Rivian Assistant. It always tells me its not available, and also when I'm about 100m from my garage, I think the WiFi handoff also ends up disabling Rivian Assistant.
