That is very interesting considering New Jersey is one of the eight states that prohibits Rivian "as a manufacturer, from directly or indirectly owning or operating a service center providing warranty service."

Kudo's to Rivian if they managed to get around this through legal or legislative means there.

That's not true...the law was changed years ago.

"This bill allows a manufacturer (“franchisor,” as defined in P.L.1985, c.361 (C.56:10-26 et seq.)) to directly buy from or sell to consumers a zero emission vehicle (ZEV) at a maximum of four locations in New Jersey."

That is interesting, I wonder why then Rivian listed New Jersey as being a state they cannot own or directly/indirectly operate a Service Center within in their S-1 filing last year.

It’s possible they weren’t allowed when they filed their S-1. And now that they are actually building and delivering they have applied and have been approved (or are expecting approval) for NJ.

This is a big possibility as direct sales still considers the manufacture as a franchisor/dealer. The bill actually calls the requirement out to have a dealers license which they may not have applied for. I didn't read the S-1 but that would be my guess.

To get a dealers license you needed to:

"..have established and maintained, or by that application shall agree to establish and maintain, within 90 days after the issuance thereof, a place of business consisting of a permanent building not less than 1,000 square feet in floor space located in the State of New Jersey to be used principally for the servicing and display of motor vehicles with such equipment installed therein as shall be requisite"

So I could see them putting it off. Do you invest in getting a service center essentially fully built, equipped, and staffed prior to being even allowed to sell in the state? Especially last year before you even start delivering? That's a bit of a capital intensive investment.

Vs this year they could train staff at Brooklyn and just shift them over to the NJ location w/o excess employees, knowing that immediately after opening they would begin servicing vehicles instead of sitting idle.

Also possible the pandemic stalled their future location and they wouldn't have been able to meet the 90 day location requirement. Just a couple of guesses..
