Same here. Came just about one month from the point that I paid out of pocket, if that helps for anyone else going down this path. They still owe me a second check for the penalties I had to pay over and above the original tax and title amounts, but that’s a much smaller check.
I noticed this for the first time this week - lost 3% overnight which was odd. I’m on the latest software, but updated a couple of weeks ago.
I simply did a soft reset of the software, and the truck only lost 1% over the past 24 hours. Will continue to monitor. ?

As far as I know, as long as the car has never been sold/titled, it's not considered used. I got into a spirited discussion at an Infiniti dealer once when they tried to sell a car with something like 3,500 miles on it as "new" because it technically had never been purchased.
