Say one were to purchase a Rivian from an individual directly after they had it delivered from Rivian. Would that still be considered a "new" vehicle purchase eligible for the federal tax credit?

Interesting. Colorado law says
A motor vehicle or truck is considered used if it was previously titled or registered and/or if it has 1,500 miles or more at the time of purchase or lease

If you're buying it from someone, then more than likely Rivian registered it to them. So it'd be considered used by Colorado law now.

Correct but that would be so a dealer can’t drive a demo for thousands of miles and sell the car as new. Any car that has been previously titled will always be used and Rivian will not deliver a vehicle not titled and registered.

Rivian doesn't register anything to anyone. They provide Manufacturer Certificate of Origin to either the 3rd party who titles and registers it for You, or gives you the MCO directly with your name on it for you to title / register yourself (a few of us did this in the early days).

Note: titling is ownership under rules of whichever state/district/territory. Registration is your annual registry that taxes/fees are paid and/or it complies with local laws (see Texas).

MCO has original purchaser's name, and is non-transferable. Ergo first owner must title to transfer it. I titled an F150 Lightning but did not register, was able to drive on temp tag until title transfer went through.

You would still be eligible for the commercial clean vehicle credit...

IF

you are self employed/have 1099 income,

AND

there was no EV credit claimed by the prior owners. The government allows for ONE claim per vehicle.

The commercial credit is much more flexible. There are no income caps. There are no MSRP caps.

Oh, that actually helps a lot Utahraptor. I didn't know about that one. Pretty sure I qualify and no MSRP caps is huge. Thanks.
