I think you missed half his comment. If he holds the steering wheel with hands below the mid point, he gets the alerts, even though he's holding the steering. Nothing illegal or unsafe about this. I always drive when in open traffic with my hands at the bottom of the steering wheel as it's way more relaxing. I'll have to take another test drive to see if this is an issue for me as well. It'd probably be a deal breaker.
It's also safer to hold the wheel on the bottom half. Less risk of wrists breaking when the airbags deploy.
