You can demand all you want but that doesn’t make any insurance company give you more money than your are entitled to based on your policy.

Your policy has nothing to do with what they will and won't give you if it is the other drivers fault.

If the other drivers insurance isn't willing to replace the vehicle, well... That's what lawyers are for.
