Why is all the responsibility on them to make it right? They made a mistake, so now they they need to be punished for it? When you make a mistake, do you want the person you made the mistake with to be understanding, or do you just want to be punished?

Sorry. I don't think like that. I expect human beings to make mistakes, just like I do, so I am willing to forgive them when they do.

This isn't a human being making a mistake. It's a merchant.

That being said, If I make a mistake, I do expect to be responsible for that mistake lol. Why shouldn't I be? It's not punishment, its accountability. Punishment makes it sounds punitive. It's not, it's owning their mistake. What's to incentivise stopping that mistake from continuing to happen?

Why can't this be about coming to a reasonable agreement between the buyer and seller? Why does somebody have to try to screw the other person in order to get some advantage? They made a mistake, so why penalize them or try to screw them over because of it?

The right thing to do is come to a reasonable agreement since it is obvious the panels cost more than just the running boards alone. Once the mistake is realized, the buyer and seller should take reasonable actions to make it right. That is how an honest relationship works in a civil society.
It’s not screwing EV Base over to expect them to deliver what they described and at the price indicated.

Ultimately, @BlackOpal was generous enough to offer to split the difference, EV Base agreed, and then went back on their word.

If anyone from @EVBASE is reading this they need to make this situation right for @BlackOpal and fix their site on the next business day so this doesn’t happen again. Having the same issue present so long after being made aware of it makes me think that the right person at EV base hasn’t been told, they don’t care, they’re incapable of fixing their own site, or are intentionally being deceptive at this point.

Again, I came to this thread expecting to defend EV Base. I can’t given the facts.

I did understand, hence the agreement to resolve the matter with a partial refund. Why are you not addressing the breach in the agreement? It's like you are purposely ignoring that aspect.

Thanks for sharing your experience.

What running boards or rock sliders do you plan to go with after you return these or would you rather keep them and have them agree on the original refund of $210 and skip the rock armor?

I am interested to know if you like these running boards with armor protection and that is why you went with them or maybe style or maybe price.

I like the rock armor panels / feature and saw it also on the EVSportline version as well.

It's a good idea that running board / rock slider manufacturers are taking into consideration the OEM panels or offering a solution that will also add function when going off-road.

Honestly, the product is okay. The install was a pain in the ass. Instructions are horrible. Buy a breaker bar to open the torx 55 screws. You can thank me later. An impact driver won't cut it. Also, install the middle bracket first and put the runners on with the hardware given. Then you can do the rest. Otherwise, you won't be able to shut your door.

As for my dilemma, I would like them to honor our agreement.

Look at the first screen shot I included. If a consumer goes to that page and they see a description of what they want to buy as the largest text on the screen (other than the company logo) and the price they are willing to pay along with it, why would they even look at the far less prominent area to choose something else?

Look at the subsequent screen shots showing the same description text and price in the cart and at checkout.

EV Base needs to fix this. I think most consumers would find this deceptive.
I think it was a mistake on seller's part which needs to be fixed in either method I described, but not intentionally deceptive and its on the buyer to make sure they check out properly by checking the boxes they want.
The subsequent screenshots show what the buyer selected, it would only show up as a different option if seller updated the models to say "without" for the two options that don't include the armor. If buyer had picked the right option the small text would have included "with armor".

Anyways, hopefully we all learned a lesson to double check before we click buy or posting a listing to our website.

I ordered it from my phone, so some websites aren't configured for it. Regardless, why does the invoice reflect the armor rockers being included? More importantly, it's bad faith when you say you will refund and change your mind.
The invoice doesn’t reflect the armor rockers being included. That’s just the title of the product and even on the mobile site it’s pretty clear to me because there are 4 model options to choose from, and you selected one without the rockers (it even shows in the pictures). Sure, the title of the product is confusing but you’re trying to hold their feet to the fire for a misunderstanding on your end. You got what you paid for.

Yeah, but how do you explain the final invoice reflecting the armor?

You are mistaken. Please see my invoice emailed from them:

I find it hard to believe anyone is defending EV Base. A poorly designed website - their fault - which advertises one thing but sells another is not an excuse in any line of business.

I wish all the cases I litigated were this black and white because I’d never have to go to trial again!

Hey fellow attorney here too. I may tag them with DTPA claim and get treble damages 😂

You are mistaken. Please see my invoice emailed from them:

Yes, that’s just the title of the main product page and the actual model you selected is reflected by the gray text below it (2025+ Rivian R1S Running Boards / Without Letter) If you had selected the armor rockers it would say 2025+ Rivian R1S Running Boards+Armors Protect Panels / Without Letter (see photo from their mobile site). Confusing for sure and they should have the product page title change when the model changes, but doesn’t take a rocket scientist to figure this one out if you’ve ever ordered online before.

@BlackOpal See this is my struggle, you don't understand the mistake you made, which means you likely haven't explained their mistake to them which is in turn why they haven't updated their website because I am sure they aren't trying to go through 1.5 months of emails to make $230 on the off chance someone doesn't order with the right box selected.
The bold writing you highlighted is the mistake they made in their product page by not listing the sliders as with "optional armor"
The smaller grey writing below your highlight on the invoice is the mistake you made which was not selecting the option with the armor.

Feel free to copy paste this to them and see if they understand the issue better and hopefully you can both come to a happier resolution.

Also, when selecting that page, it does state prices "From $549.99"

I work in e-Commerce. This could be as simple a content management issue, an A/B test gone awry, a design issue, or a functional bug.

Sites usually have an out with regards to pricing errors. Regardless, it's poor customer service to throw the customer under the bus. As a show of good faith, to make up for the confusion, the vendor should take care of the customer in some way. It appears that there was an initial agreement, but it was tossed. That's terrible customer service x 2.

My company would eat the $$$ on our error (and, we have in the past). Seeing how EVBase is treating a customer would make me think long and hard about purchasing from them.

I'm not trying to hate on you, I promise even though I know it sounds that way, but if you put the correct item in your cart it will reflect that item on your invoice.
Again, they 1000% need to change how they list their item by adding the word "Optional" right in the red underline to make this super clear. But I suspect most people were able to check out with their desired item.

I have thick skin. Nothing you say or anyone say will affect me. However, I find it disingenuous that you don't acknowledge the breach in the agreement. It doesn't bother you that they agreed to a refund and then reneged?

Sure it does, but we don't know the full context. If it was presented as they shipped the wrong thing and they tried to make it right then realized you ordered the wrong thing and they shipped it correctly, thats one thing. They should have honored what they said but nobody knew what the issue was to start with and it sounds like.
Your breach in agreement doesn't count? You (accidentally) ordered the wrong thing you didn't want. Own your mistake too if you are going to hold them to theirs too.

Don't let me make excuses for them, I'm also a stickler for this stuff and went through a similar price match fight with Best Buy recently. Finally went there in person and the manager explained she was understanding that corporate went back on their word but she didn't have authorization for that high of a price match (ironically pretty similar pricing as your sliders but on a cellphone). I understood, she waived the return fee, and we both moved on happily.
(FYI to anyone still reading, never price match online with Best Buy, they take 2 weeks to decline it once it is out of stock. Always do it in store)

On the flip side, I also sell things and understand that as a business owner I have to make good on what I say I will do. I always make sure that what I offer exists, even if I get the pricing wrong and need to eat it.
