I was on my way to pick up my son from school yesterday and was stopping with the flow of traffic at an intersection when a Chevy Silverado with a tar kettle trailer slammed in to the back of me(probably going 35+ mph). I had just picked up the rig last Wednesday (166 total miles?) After reading through a lot of these threads I’m concerned about the timing to get this fixed as parts are likely not readily available. There’s also a brown sort of fluid that appears to be leaking from the rear undercarriage of the vehicle and the sensors and hot spot no longer work.

Silver lining is the R1s is built like a tank. Thankfully my pregnant wife and son were not in the vehicle.

Any advice on how to navigate next steps would be greatly appreciated. (I’ve already gotten an attorney)

Over react much? An attorney from the outset is a bit extreme. File a claim, either with your insurance or theirs, wait a week or two for the settlement details and then decide if that works for you.

I've not had to navigate this process very many times in my life (luckily), and definitely not recently when I could afford nicer vehicles, but many here who have been through this looked into a diminished value claim.

Over react much? Nah I ended up in the ER with a concussion and am a year and a half out from a disk replacement in my neck, so sit this one out buddy

Yep, been there, done that, didn’t need an attorney to settle. I wasn’t even strapped inside one of the safest metal cages on the road and got to see the other person up close and personal through their windshield before sliding down the road.

Still, best wishes to getting the truck repaired in a timely manner and your medical needs sorted.

I hope you have a quick physical recovery and insurance takes care of your R1S. The Rivian seems to have held up very well given the front of the truck which hit you! Seeing that makes me feel like the 3rd row is very well protected.

Some insurance policies will probably cover the full cost of a new vehicle since it's only a week-old unit, and you might be able to take advantage of Rivian's Quarter-end offers for a brand-new replacement.

I would investigate that route with your insurance ASAP, they would have to deal with the other driver afterwards.

I'm truly sorry this happened to you and your brand new Rivian. Getting a atty is wise as they can work on your behalf that way you can focus on your own life and well being.

Its really difficult at least on this old laptop the amount of damage you showed on the sides of the Rivian. But its clear the rear has significant damage. I hope your not too banged up and your new ride is fixed up in a jiffy.

Depending on the OP, who sounds like he did have to get medical attention and might need more ongoing treatment, and the other party, who might be underinsured, etc...having an attorney to at least review the case isn't a bad idea. They'll tell you straight-up whether it's worth starting a legal claim (they're not going to go through the effort on a claim that can be settled easily by paperwork and insurance alone), but at minimum they'll at least give you some small nuggets of advice even if they decline to take the case.

(A) I'm glad it wasn't way worse! I'm very sorry you were injured, of course, but looking at the other guy, your "tank" kept it from being a catastrophe.
(B) My R1T has been in a Rivian Certified Collision Center for more than six weeks after a relatively minor fender-bender. The vast majority of that time was just the shop waiting for parts from Rivian. Even though it was not a huge deal, the estimated cost is about $13k. My insurance company initially balked at this, but they relented when none of the shops they wanted me to use would even consided the job (a common tale seen on this forum many times).

In your case, there's an injury involved and another driver who is clearly responsible, so your insurance company will be eager to go after the other guy's insurance.

My (unreliable!) crystal ball says that you won't have your car for quite some time--better allow for a month or more (and then you'll be super happy if it gets done sooner!). Insurance might provide a rental that might be a reasonable facsimile.

Seems to me that having an attorney in your corner is never a bad thing, but work closely with your insurance company--this is really what you've been paying for.

First, make sure you get yourself checked out. Even if it doesn't feel like your hurt sometimes you can start having pain a day or so later.

Insurance might be a pain..but generally...this should be considered a brand new car. If it has under 200 miles its kind of hard for them to argue it isn't brand new vs. used. Need to ask your attorney about this as I am not an expert.

I am so sorry this happened to you. I’m so sorry that you were hurt. It looks like your Rivian held up pretty well, especially compared to the other car.

Years ago I was getting my Jaguar serviced at the dealership and a flatbed tow truck showed up with a Jaguar XJR with 30 day tags and a smashed in front end. One of the sales reps said he had just sold it an hour ago and the new owner hit a buck going 60 about a mile from the dealership. It had less than 20 miles on it. So your not the only one!
