I love how they say there's no systematic problem with their automatic system, yet the internet is full of people incorrectly denied credits. Also, very convenient they don't track the disputes and appeals.

They should be manually reviewing the rejects before denying credits. Many of us submitted the required documentation, which seems to not be considered at all in their automated process.

CDOR used to be relatively easy to work with, but they become more difficult to deal with every year it seems.

You can protest online at https://www.colorado.gov/revenueonline/_/ - the option is in the center section, next to last row - "protest a notice or letter".

Most have been submitting vehicle registration, bill of sale, as well as a photo of the door jamb sticker. I wouldn't get to caught up on the wording. From the news story posted above, it sounds like their automated system just sucks - so they don't even look at what was submitted until you protest.

My denied $2000 credit was just direct-deposited into my account yesterday, so absolutely do the online protest. In addition to what you listed above, I uploaded this marked-up photo of what the CO law states:

seems like there's no reason R1T owners shouldn't get either 2800 or 2000 back. I submitted my protest in March and still haven't heard back...

Unfortunately the issue is not limited to Rivian. My 9/1/2023 Tesla purchase was denied on my 2023 taxes. I filed online protest/appeal 5/1/2024. Crickets so far.

I finally received a letter from the Colorado DOR today, dated June 10, admitting that the credit was wrongly withheld and that the claimed credit of $2,000 will be refunded to me. My original protest was filed online March 5 so it took a while. No doubt they have a big backlog of protests to sort through. Given all the press, it is my opinion that they just rejected all of the Rivian credit claims (and maybe all other EV credits) without any idea what the GVWR was. "The computer did it...." That's why the rejection notices were so generic.

I wouldn't replace my Gen 1 with a Gen 2 for no other reason that I would have to deal with the DOR, again. :)

Had you appealed? I never received anything from them. They just removed it from my refund. Not sure how to appeal when I don’t have a letter from them.

Yes I appealed back in March I few days after they adjusted my credit from 2800 to 0. My appeal was online through the portal and included a picture of the original window sticker. So it took them about 3 months to get back to me.

If there was a human to speak to, I would have asked for interest. My credit was direct deposited pretty quickly after receiving the letter. Saw it online at my bank. No other communication from CDOR.

I also just got a denial letter for the $2,000 credit for not registered in CO and GVWR not qualified for the credit, despite including a copy of the CO registration and photo of the door jamb sticker with my return.

They appear to be just issuing blanket denials on all of these and requiring substantiation through the protest process. It's very annoying and really just creates more work for them. I don't know why they don't take 5 minutes and just read the original attachments.

I just filed my protest online.
Protest was processed and the credit was approved on 7/16 - just under 2 months after I filed the protest. I did call in last week, where the agent pre-reviewed my protest and placed it on a tentatively approved list of some sort. I wonder if this would have processed quicker if I had called just after filing the protest. May be worth a shot to call in after protesting for others (or if you're still waiting with no info after filing).
