It is 100% a Rivian issue. They offered him a new truck after f'ing his up and then changed their mind. I don't get how people don't see this. Was Rivian within their right to offer a comparable truck, absolutely but that should have been the offer from the start. Of course OP is going to be angry that they changed the terms. Who wouldn't be.

I want to see the written response that Rivian supposedly gave him. He posted this exact story on the Facebook group.

If someone hits you and totals your car, you get the value of the car...you don't get a brand new car. Nothing different about this here.

roght? It’s comical. And just because some advisor misspoke now he is like ‘nope! No take backs! Give me my new truck!’ Lol

Agree with most commenters. Shit happens and that's what insurance is for. OP needs to made whole for whatever their vehicle was worth at the time of the accident (i.e how much ever a 2023 R1T with 30k miles is worth on the market). Rivian should make additional amends, within reason, to compensate for any loss of vehicle availability (ex. comparable Rental car) and possibly good will (ex. a gift certificate to gear shop). OP's insurance premiums shouldn't go up as a result of this since it wasn't their fault.

However, expecting Rivian to foot the bill for a brand new truck (even if an employee messed up and made an unrealistic promise) may not result in math mathing and result in a ripple in the fabric of fairness.

Right... Some employee at Rivian told him he can get a new truck but forgot to mention that he needed to pay for the 3 years of use in owning it and now both you and he expect Rivian the rich guy to "do the right thing" by opening their inventory and say pick one at no cost. Dream on...

So? Someone overpromised. OP didn't incur any loss as a result other than disappointment. We also don't know what Rivian told him. We know the paraphrasing posted in the OP.

Some good discussion here. Thank you for a clearly worded and detailed post. Not much to add, but just agreeing with the comments that it is frustrating that you were told they would replace it and then walked that back. Was that in writing?

I also believe they should provide a like for like replacement. Best of luck getting this resolved, please come back and update us when you do.

It's how the yellow truck in my profile pics end began. (not at a Rivian SC - but at a 3rd party Rivian contracted for warranty paint work).

OP, Just curious, if you had a 2023 loaner from Rivian and got in an accident causing 32k in damage, would you be OK if they insisted you replaced it with a brand new vehicle?

Accidents happen, always unfortunate but expectation should be to be made whole, not put in a better position by getting a windfall.
