No, he absolutely did not say that. Now, I’ve consistently called Elmo a lying weasel and untrustworthy, but also, that he believes his own bullshit. He’s also an eternal optimist which is good and bad. We wouldn’t have an amazing global communication system if he didn’t blindly believe it could happen while everyone said it was impossible.

Anyway, it’s probable that he was just wrong and overly optimistic. Remember Rivian promised Gen 1 self driving too.
So because he believes in his own BS, he gets a pass? If he were just some rando, you would have a point. But he is the head of the company telling stock holders and paying customers the same BS over and over. At some point there needs to be some kind of accountability even if he believes what he is saying. Someone in his position should be able to recognize that "I keep saying X but reality keeps being Y" and make an adjustment.

During Wednesday’s earnings call, the mercurial CEO put it as bluntly as ever.

“Unfortunately, Hardware 3 — I wish it were otherwise — but Hardware 3 simply does not have the capability to achieve unsupervised FSD,” he said, saying that its “memory bandwidth” is the “chokepoint.”

...
Musk explained during this week’s call that Tesla is now looking into constructing “microfactories” in cities to retrofit HW3 vehicles with a new computer and camera system.
Did he say that the upgrade would be free

So he's an engineering genius and understand all the problems involved in populating Mars. And with that knowledge and intellect he genuinely believes he can make this happen in the time frame he has stated.

Because he's an optimist. Or perhaps because he is something else...........

Yes, it has to be free for everyone who's already paid for FSD. Typically they've offered the same upgrade as a paid charge to anyone who hasn't paid for FSD.

However, I do recall numerous claims about "every Tesla sold from now on has all the hardware needed for FSD, built in," so that could conceivably be part of the purchase value prop for anyone buying and not selecting FSD, they might be in a situation where they will have to upgrade people who opt into FSD now (including subscriptions). If so, I'm thinking they will try to jack up the one-time buy price and drop the subscription option for anyone in that category?

No, please re-read my post as written without adding your own words. The rest of your post is based on misreading what I said. Maybe purposely, dunno.

I'm sure he believed (esp. at first) that HW3 could get to FSD.

I'm sure he was plainly aware that there was a very high possibility that he was wrong, and as time went on he knew the chances of HW3 being sufficient were slim-to-none.

I'm sure that despite this, he decided it was important to continue to say that HW3 was powerful enough.

I'm sure he'll somehow get away with it this time, as he has since 2016.
Heck, he believed HW2 could do it.

I don't see how anyone could have believed that HW3 (or 4) vehicles ever had any chance of unsupervised driving.

Even if the software and the computer were up to the task, the rest of the vehicle isn't. Only the front camera has a wiper! And it only has a wiper because the human needs it.

How can a vehicle with cameras that are completely and perminantly (from the perspective of the automous vehicle) disabled by a single drop of dirty water ever hope to drive without a human ready to take over at all times?

No computer science degree or understanding of AI capabilities was needed to call BS. All you needed was one day of experience driving a vehicle with a built-in backup camera to immediately see that the vehicles didn't have the hardware that would be needed for it to drive the itself without a human ready to take over.

So yeah they were lying and knew it. But I have no sympathy for anyone who claims to have been fooled.

I think we can apply standard legal language here:

If he knew but kept pretending it was fine then it is fraud. If he ought to have known and kept saying otherwise it is negligence. So what did he know and when did he know it ... and when do I get my $5k back for faulty fsd hardware that led to a zero resale value bump?

FSD was always coming soon. Written disclaimer was always for a driver to pay attention.
