Sorry about the disappointing missing recordings. Not the first I've heard of an incident/accident not being written to recording. I often check the little save progress bar after honks to verify the event saving to drive. If it does not, I then manually hit the save icon. I know it won't help this time, but putting this out there in the future for you and any others.

As for the lawsuit, I would hire a lawyer. Ideally someone who has experience defending against such claims and filing counter-claims to recover your expenses. I assume there were no viable witnesses?

Thanks. That is a good idea - I'll start doing that when I get it back from the repair shop.

I'm hoping my insurance company pushes harder but so far no luck. Hiring a lawyer may be the next step..

No witnesses and I called the nearby businesses to see if they had video and no luck.

Rivian records/has an option to record all drives continuously like a dash cam. These are viewable only by connecting the USB c drive to a computer or phone. It is not clear from your post that you checked all videos.

Incidents are viewable from the car and are limited to detected events.

The girl who hit me was doing uber eats and so her personal insurance won't cover it... she got an injury lawyer and is now claiming injury. The police report is pretty useless because we had differing statements. So its a she said, she said situation.

If you haven't already involved a lawyer, sounds like you need one of your own. A lawyer should also be able to assist in obtaining any evidence that Rivian may be able to provide (even though it sounds like there may be nothing to provide).

Not sure if it was mentioned, but you may have luck getting traffic cam footage from the city or a local business. It never hurts to ask.

I've tried four thumb drives and one NVME drive (currently a 512GB thumb drive, recording up to 400MB/sec) . None record reliably. My RoadCam has recorded only four videos in three months.

My IncidentCam missed the moment I nearly got T-boned. When I checked the RoadCam footage, there was a brief glitch that skipped the 15–30 seconds when it happened. I reported it, but Rivian couldn’t find or fix the issue.

I was T-boned a few decades ago. My neck still hurts! Don't assume pain will be temporary. Get an X-ray or MRI.

USAA. They are doing their best but with a unclear police report and the other party having a lawyer (and refusing to make a statement) there isn't a great path forward.

Takes a hell of an argument to say the person with a parked car bears any responsibility lol.

I actually had the same thing happen to me earlier in May. I was involved in a crash and I looked at my Incidents and nothing was there. Later pulled the USBc drive out to review and nothing was on there - recording stopped about 30 seconds or so before the actual incident.

I posted on Reddit about this and found that this has happened to others, including Tesla drivers as well. Seems to be a software bug where when the impact happens, if it’s hard enough, the system stops writing the video to the drive. If you search this issue on Reddit you will find more users with the issue.

FWIW, this happens with dashcams too...they sometimes don't record if the impact is sudden enough.

That said, I agree Gear Guard should have worked...running a backup dashcam isn't a bad idea though...

Some clarifications

The USB drive that is plugged in isn't used for backup. It's the primary drive that's used for recording.

You can see if its working by looking at the icon on the screen.

I have seen some cases where it wasn't working where I had to reseat the USB drive or do an infotainment reset.

It's always recording while your driving and the only point of honk to record or incident recording is so its viewable in the vehicle.

If you want to view all the drives you have to safely eject the drive and plug it into a computer. Then find the video time stamp that you're looking for.

For me its been pretty reliable when I pulled the drive and used my computer to find It. It's been rather useless at watching videos in the vehicle. Pushing the record button has to be done so soon after the incident that its useless.

If the video isn't there on the computer then its likely that it wasn't recording which really sucks. But, that's technology for you. It fails just when you need it the most.

Yeah, but this is a Rivian.

It barely moves when hit.

Will be interesting to see when the last recording was. If it was hours before then its likely that the it was some SW issue preventing recording.

I think Rivian still does the splicing thing where they limit the file size. I do believe I saw this as well when I was trying to use video footage to prove I wasn't speeding.

Sadly the video footage proved I was.

Rivian could have made the whole thing a lot easier had they overlayed the speed on the video. For this alone I think it might be worth getting a proper dash cam.

Reading this thread has me thinking about buying myself a legit dash cam instead of relying on Gear Guard. I don't believe the gear guard working intermittently is a good thing, but ultimately it's an ancillary feature. It sucks that you couldn't rely on it, but there's only so much Rivian will be able to do for you.

I think it's fair to be disappointed, but the significant issue here is with the other driver.

I’m so sorry for your situation. Accidents are just that. We want to blame someone but unless someone was obviously distracted on phone or drunk, it can happen to anyone. I was in a similar situation. No recording. Highly disappointed. Tesla does it very reliably. This is unacceptable for such an expensive car and for the feature it falsely advertises. It’s not ready for prime time. Also the repair costs are astronomical. Although that’s true for most luxury cars these days, it’s even more so for Rivian. That will definitely come down over time. THere are others who know this obvious fact and don’t want to spend so much on a new company. 3 of my friends who were in the market recently for a 100K car said no thanks. But at the end of the day, we kind of knew what we were getting into. It takes 10 to 15 years for the reliability to be at least average. It may take another 20 years for it to be Toyota or BMW or Porsche level of reliability (yes the new ones are highly reliable). But, the car is awesome otherwise . It has a lot of potential and such fandom. Even though I had a bad experience, one day when I can afford it again I will buy it again.

Regarding reliability I've had the exact same number of issues with Rivian as my wife has had with BMW and less than I've had with Audi.
