Go back to scene of “crime” and try to replicate when the street is empty of traffic. Have someone else video from outside and inside vehicle. Smells like fraud and attempt to extort. At the very least, you need something to support/mount your defense to insurance.

Have heard of parked vehicles sliding overnight on ice. Never in other situations.

Fastest way to verify your fault / no fault will be with drive cam, and/or checking to see if you have ((H)) on the driver display which will indicate a Brake Hold failure.

Anything else at this stage is conjecture.

If the drive cam / gear guard shows you rolled backwards, you're guilty (regardless of truck tech fault). If it shows you were stationary and hit, then success - send to your insurance.

If ((H)) shows up then you're still technically at fault, but at least you know the truck's brake hold is borked and needs service.

Yes, most people do not get distracted while stopped at a light. But, not everyone is so proper, perfecto, aka are humanos.

I would never admit to anything to anyone, unless I am 100% certain. Even then I limit what I say. And yes, I have fully admitted when I was at fault, even after “pleading the 5th”.

Like many have noted it is almost impossible for the R1 to roll back, unless you are in off road mode or deliberately shift into neutral.

Hopefully you have that gear guard video.
I wish I didn't react so quickly, I feel like I'm fighting an uphill battle at this point... pun intended. But ya, after reading everyone's responses and really looking into it today, I do feel like the car did not roll back. Still waiting to hear about gear guard... hopefully that will clear it up. Thanks for the info

You didn’t roll backwards, OP.

The guy behind you is trying to take advantage of your situation. It’s more likely he took his foot off the brake and crept into you, or was on the gas holding the hill not paying attention.
That's actually very clever and possible... thanks for that insight. That makes a lot more sense than the R1S rolling backwards. If he thought he had the brake and lifted his foot a little I'm guessing it could have rolled forward

Wondering if you are allowing the R1S to "preheat" for faster charging? You must enter the destination in the map navigation each time you go to charge

Yes. Really pisses me off seeing people on their phones in the car. You are lucky it was this minor.

I'm sorry this happened to you. I'm a little less sorry because you didn't have your foot on the brake while resting on a steep hill, AND you were so deep in your phone you didn't notice yourself rolling back or the person behind you creeping up. Just because a vehicle has a feature, doesn't mean you should abandon normal driving skills.
Again, I really am sorry this happened to you, especially in someone else's car.

Never had this happen to me in a Rivian, but it happens pretty regularly in my wife's i4M50. The hold on that car doesn't always work and you have to stop abruptly for it to engage.

When I got home last night I tested this on the steepest part of my driveway which is 7% grade. 5 times I stopped on the hill by only lifting off the accelerator (no braking), 5 times there was no rollback.

I have never experienced my Gen 1 R1S roll backwards on a hill, ever. Hold has consistently been pretty reliable for me.

I had a random set of errors for a drive home last weekend that could result in this. Cleared up for my next drive a bit later.

So it can also happen with a set of errors, but those would likely be noticed on the dash plus the pop up warning about driver assist issues (I think that was the gist of the pop-up).
