Very sorry to hear about your incident but glad that no one was hurt and hope it works out for you in the long run.

I know this is small consolation but until recently, I was considered "accident prone" by my insurance company due to two incidents in which my parked cars were hit. One was while parked in a space in a store lot, the other was while parked on the street in a residential (25 mph) area. In the case of the latter, the car was driven up and over the curb, onto the lawn of the house I was parked in front of, and the vehicle that hit it caromed Into a tree in on the adjacent lawn. That car, a beloved Passat VR6, was totaled., but the other was a minor fender bender. In both cases, the car was unoccupied and legally parked, and the offending drivers had been drinking (both were cited post accident).

None of this mattered to the insurance company however, and my rates were adjusted upward accordingly. The moral of the story is that life ain't fair and insurance companies often provide the best examples of that.

It wasn't stored on my vehicles drive. Rivian has told me that if it isn't in the video section of my screen, it doesn't exist anywhere else. Despite that, I have an appt at a service center to try and recover anything they can find. No one at Rivian even told me that was an option... I found that out myself. I don't have high hopes but it is the only other option I have found.
Yeah, that sucks. Also, the post may seem condescending from a "did you do this, did you try that" standpoint, but you'd be surprised how often people put the blinders on, and the responses above solve their problem.

Hopefully the service center can pull the vehicle logs.

On the Rivian Guides end of things, that was phased out shortly after initial launch (2021-Early 2023) and became more generic interactions between owner/Rivian. My personal take on that front, is there was a decent learning curve and scarce information on Rivian use and nuances early on, especially for new to EV owners, Rivian Guides were a knowledge base for anyone not sourcing information from a Forum, like this one. As time went on, guides became less useful beyond an initial purchase, and even that became more of a generic interaction.

Wowww. I'm so sorry. Unbelievable but believable. And honestly, misery loves company and you are good company in this situation. So sorry!

No, I get it. I for sure appreciate you asking the questions. If there is something I missed, I definitely want to be made aware!

Re the guides... I wouldn't be upset if it wasn't "sold" to me differently. He was very "call me anytime, with any problem etc etc". He made no effort to help me escalate trying to get the data. Its just a big bummer all around.

I agree to an extent but I do think I should be able to rely on a brand new car to do what it is advertised to do. And have some sort of support from the company for the failure of that feature. I don't blame rivian for the accident at all. I blame the person who is lying and was driving distracted. BUT I am still allowed to be frustrated and disappointed with the vehicle and Rivian as a company.

Side note - I have been obsessed with Rivians since they came out. No one was a bigger fan than me. I saved and saved for years to be able to buy this car. So maybe the downfall hurts more because of this.. idk.
If you can see things in gear guard then it is working. There isn't a 100% guarantee it will record everything. After over 3 years a Gen1 and now a Gen2 R1S I am thrilled with Rivian overall.

The girl who hit me was doing uber eats and so her personal insurance won't cover it... she got an injury lawyer and is now claiming injury. The police report is pretty useless because we had differing statements. So its a she said, she said situation.
I hate it when people don't own up to their mistakes, and then further double down on the lie.

Rivian records/has an option to record all drives continuously like a dash cam. These are viewable only by connecting the USB c drive to a computer or phone. It is not clear from your post that you checked all videos.

Incidents are viewable from the car and are limited to detected events.

Sorry about the disappointing missing recordings. Not the first I've heard of an incident/accident not being written to recording. I often check the little save progress bar after honks to verify the event saving to drive. If it does not, I then manually hit the save icon. I know it won't help this time, but putting this out there in the future for you and any others.

As for the lawsuit, I would hire a lawyer. Ideally someone who has experience defending against such claims and filing counter-claims to recover your expenses. I assume there were no viable witnesses?

I had a somewhat similar experience as well.

My wife and I moved into a rental apartment, while shopping around for insurance that would cover our bikes as a separate line item/deductible we were in the final stage and just needed to sign the paperwork to finalize. The next day I was at work and my wife called asking if I rode to work, I said no, and asked why? She said my bike was not on the 3rd floor balcony any more.

I got home and realized Spider Crackhead scaled the building in the middle of the night and chucked my bike into the hedge below and took off.

Being honest to a fault, I notified the insurance company that, "I understand the policy hasn't taken effect yet, but needed it altered as one of the bikes listed was stolen last night. I understand, it was stolen prior to the policy taking effect, I just don't want to pay for insurance on 3 bikes, when I only have 2. and could they make the addendum"

Got an email back that our insurance coverage was denied approval, because we were too high risk.

My gut was response was a big old FUCK YOU to the heavens. I literally could have waited 2 days and then reported the bike stolen and claimed the 5k to replace it, instead me notifying them ahead of time and not costing them a dime, was "the wrong thing to do"

While committing insurance fraud isn't my take away lesson from this, it's more that people, and sometimes companies, can suck.

Sorry you’ve had to go through this—truly sucks. While we can’t change the past, now that you’ve gained some hard-earned experience from this mess, I’d suggest considering a third-party dash cam as a redundant backup.

Surprised no one’s brought it up yet, but all software is prone to failure. Most honest Rivian owners here will agree: the software is still very much a work in progress, and each update often brings new bugs alongside new features.

When I first picked up my Gen2, both DriveCam and Gear Guard didn’t work at all due to early Gen2 software glitches. Since then, I’ve experienced several other bugs that have intermittently disabled various vehicle functions, both big and small.

With Rivian—and really, any newer EV startup—you’re essentially an alpha tester when it comes to software. So at the very least, having an independent dash cam gives you a bit of peace of mind when the built-in systems decide to flake out.

Yeah you couldn’t have waited to get the policy and then claim it was stolen because that would be fraud, as you insinuate.

However, you also didn’t have to tell the insurance company WHY you were going from 3 bikes to 2. You could have just said you only wanted to insure 2. Lesson learned. And I know, it sucks. I feel you.

What insurance company? Usually for accidents where you aren’t at fault, they don’t really hold it against you…?

USAA. They are doing their best but with a unclear police report and the other party having a lawyer (and refusing to make a statement) there isn't a great path forward.
